Adams Tutors Terms and Conditions and Contract

Introduction

The Copyrights of this website and any material that is issued by Adams Tutors rest with Adams Tutors or its licensors. All rights reserved. Users should not create links to this website from another website or document without Adams Tutors’ prior written consent. 


Although great care has been taken to check the site and its contents, including our resources, for errors and any breach of copyright, if any such breach is suspected, then please let a director know immediately, and the material will be taken down and/or rectified as appropriate. 


By confirming a tuition placement, as either a Tutor or a Client, you explicitly agree to Adams Tutors Terms and Conditions. Adams Tutors Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. 

  

General


Adams Tutors reserves the right to reasonably alter these terms and conditions. Unless otherwise agreed in writing by a Director of Adams Tutors, and with the exception of specific employment contracts, these terms and conditions shall prevail over any other terms of business or conditions put forward by the Client or the Tutor. 


Once a tutorial is confirmed, the “Tutor” and the “Client” (the student, or the student’s parent/guardian) have entered into an explicit tuition agreement as governed by Adams Tutors’ Tuition Agreement Documentation (provided on request). Adams Tutors acts as agent on behalf of the Tutor and the Client. Adams Tutors is only responsible for finding students and matching them with an appropriate tutor for the specific subject. Responsibility for the content of lessons, and the teaching methods employed, remain with the tutor. 


Non – solicitation 


The Client – or anyone acting on behalf of the Client – is not permitted to make private arrangements for tuition with a Tutor introduced by Adams Tutors. Should a Client breach this obligation, they will be liable to account to Adams Tutors for all sums paid to the Tutor, without deduction, and Adams Tutors shall be entitled to obtain an injunction against a Client to prevent further breaches. This obligation shall continue notwithstanding termination of this agreement. Similarly, if a tutor is found to be soliciting clients for private tuition arrangements, at a minimum they will be dismissed and a maximum reparations may be sought through the courts for quantifiable damages. Payments for tuition services must be made directly to the Tutor. 


Cancellation Policy 


Both the Client and the Tutor must notify the other in advance of any holiday commitments they may have, and any changes to the tuition timetable necessary because of illness or inconvenience. Tutorials must be cancelled a minimum of 24 hours prior to the arranged tutorial start time. If the client cancels the session within 24 hours of the agreed time and date, then the tutor will need to claim the full cost of the lesson. Any cancelation more than 24 hours notice will not be charged, with the exception of prearranged expenses.


Late Arrival Policy 


If the Client arrives late, without sufficient prior notice, and the Tutor does not agree to overrun past the allotted tutorial, then the full scheduled tutorial is billable for the tutor. 


Damages 


Adams Tutors do not accept any liability for any claims by the Client arising out of, or related to, Tuition sessions, tutorials or any other activity by the tutor. By accepting these terms and conditions you agree to indemnify Adams Tutors, without limit, in respect of any such claims. 


Unethical Academic Conduct 


Adams Tutors has a zero tolerance policy on unethical academic practises included, but not limited to plagiarism and intellectual property violation. When matching a Tutor with a Client, it will always be made clear that any such unethical practices can result in the immediate cancellation of a tutorial and disciplinary action up to and including dismissal of the tutor. Adams Tutors accept no responsibility for plagiarism, and full liability lies with the Client. A Client’s work should always be their own. 


Approval 


By contacting Adams Tutors and seeking our services, is an explicit agreement to these Terms and Conditions. 

  

Tutor – Client Relationship


Adams Tutors acts as agent on behalf of the tutor (Tutor) and will introduce the Tutor to the client (Client). Adams Tutors is only responsible for finding and matching students with an appropriate tutor for the specific subject, and is not responsible for the content of lessons nor the teaching methods of the tutor, nor does Adams Tutors accept any liability for the consequences of such tuition, including, but not limited to, exam results and dissertation scores. 


Fees and Payment 


The billing process for the course or lesson will consist of the Client paying the full amount using online payment method prior to the course or lesson commencing. 


In circumstances where a tutor is required to have specialist experience, Adams Tutors reserves the right to increase tuition prices but the Client will be informed accordingly before any session takes place.
 

Expenses 

The Tutor may charge additional expenses such as textbooks and other material to the Client, but these must be agreed upon before each tutorial with the client and the tutor. 


Liability 


Adams Tutors do not accept any liability for any claims by the Client arising out of, or related to, the carrying out of the tutoring by a Tutor introduced by Adams Tutors or any lessons or courses that Adams Tutors provides. 


Cancellation


If the client cancels the session within 48 hours of the agreed time and date the course commences, then the Adams Tutors will need to claim the full cost of the course. Any cancelation more than 48 hours notice will not be charged.

  

Tutors


The following arrangements are understood and agreed by both parties: 


Private Arrangements 


In consideration of Adams Tutors providing you with students, you are not permitted to make private arrangements or enter into a private agreement with Clients of Adams Tutors, or any person who has or is likely to have a business relationship with Adams Tutors. Should you breach this obligation, you will be liable to account to Adams Tutors for the full sum or sums received by you from the Client or Clients introduced by Adams Tutors. Adams Tutors shall be entitled to obtain an injunction against you to prevent further breaches. This obligation shall continue notwithstanding termination of this Agreement. Any work referred to a tutor by a Client or Clients of Adams Tutors must be treated as though Adams Tutors has made the match between the new Clients and the Tutor. Adams Tutors are happy to negotiate on commission for new clients referred to you, as well as reasonable expenses incurred, but Adams Tutors must process the billing for tax and legal purposes.
 

Environment 


The Tutor and the Client are responsible for finding and agreeing on a suitable environment in which the tuition or course can take place. It is the Clients responsibility to find a safe and suitable working space in which to conduct the tuition. 


Payment 


Adams Tutors will agree the fee structure of the courses or tuition with the Client and this must not be changed without the written authority of Adams Tutors.


Data Protection Act


The Adams Tutors uses tutor data for the purposes of the services that it provides. Tutors providing personal data consent to the use of that data by Adams Tutors for the purpose of effecting introductions to clients, for billing and fee collecting purposes, and to enable Adams Tutors to contact the tutor from time to time. 


Specific Terms and Conditions 


Tutors will be provided with Specific Terms and Conditions that relate to their activities with Adams Tutors.


Tutors Conduct


Tutors need to be punctual and neatly dressed for each session.


Tutors need to report back to Adams Tutors with any problem or concern.


Tutors are told that there should ALWAYS be a third party present during a lesson with a student. The location for the tuition should always be entirely suitable and appropriate.


Confidentiality 


You undertake that you shall not at any time disclose to any person any confidential information concerning the business, affairs, customers, Clients or suppliers of Adams Tutors, except that you may disclose Adams Tutors confidential information as may be required by law, court order or any governmental or regulatory authority. You shall not use Adams Tutors’ confidential information for any purpose other than to perform your obligations under this agreement.
